TERMS AND CONDITIONS OF SALE AND USE

- IDENTIFICATION OF THE SELLER In accordance with Article 10 of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI‑CE), the owner of this website (the “Site”) is Bohdan Lazurenko, a self‑employed professional (autónomo) registered in Spain under tax ID Z0695392S, with registered address at Calle Patricio Perez, 47, Local 4, Torrevieja, 03192, Spain, contact email bohdan.lazurenko@gmail.com and telephone +34602542729.
- PURPOSE AND SCOPE These Terms and Conditions of Sale and Use (the “Terms”) govern access to and purchases of downloadable digital guides (the “Products”) through the Site. By placing an order you agree to be bound by these Terms. You must be at least 18 years old and act as a consumer.
- ORDERING PROCESS 3.1 Steps: (i) select Product; (ii) review basket; (iii) enter billing details; (iv) make secure payment through Stripe via SureCart; (v) receive on‑screen and email confirmation. 3.2 The checkout process and contractual documentation are offered in English. A copy of these Terms is available for download and permanent storage. 3.3 Error‑checking: before confirming the purchase, you may edit or remove items and correct data entered.
- PRICES, TAXES AND INVOICING 4.1 Prices are shown in euro (EUR) and include Spanish VAT at 21 % unless otherwise stated. 4.2 For customers resident in other EU Member States, the correct VAT rate is calculated automatically under the One‑Stop Shop (OSS) scheme. 4.3 A PDF invoice will be emailed immediately after payment to the address provided.
- DELIVERY OF DIGITAL CONTENT The Product is deemed delivered when the download link or account access is made available. The link remains active for unlimited downloads or unlimited days. You are responsible for keeping a backup copy.
- WITHDRAWAL AND REFUND POLICY 6.1 Statutory framework. Under Article 103(m) of Royal Legislative Decree 1/2007 the 14‑day statutory right of withdrawal does not apply to digital content once the download has started with the consumer’s consent. 6.2 Voluntary guarantee. Notwithstanding section 6.1, we offer a 14‑day no‑questions‑asked refund. To obtain a refund, email [EMAIL] within 14 calendar days of purchase quoting your order number. Refunds are processed to the original payment method within 7 business days. 6.3 Loss of access. When a refund is issued, your licence is revoked and download links will be disabled.
- LICENCE OF USE Upon payment you obtain a non‑exclusive, non‑transferable, worldwide licence for personal use. Reproduction, distribution, public communication, resale or transformation is prohibited without prior written consent. (Spanish Intellectual Property Act, Royal Legislative Decree 1/1996).
- TECHNICAL REQUIREMENTS & UPDATES Supported formats: PDF / EPUB. A PDF reader is required. Free lifetime updates to minor revisions of the same guide are provided; major version upgrades may be subject to an additional fee.
- USER OBLIGATIONS You agree to (i) provide accurate information; (ii) refrain from circumventing technical protection measures; (iii) use the Product only for lawful, personal purposes.
- LIABILITY AND WARRANTIES We warrant that the Product corresponds to its description and is free from technical defects. If the Product is defective we will replace it or refund the purchase price. Our maximum aggregate liability shall not exceed the amount paid for the Product.
- PERSONAL DATA PROTECTION Please consult our Privacy Policy at https://evtopa.com/privacy-policy/ for full details of how your personal data are processed. The data controller is EvToPa. Legal basis: performance of contract (Art. 6 b, GDPR). Payment data are processed by Stripe; SureCart stores order data on EU servers.
- ONLINE DISPUTE RESOLUTION If you have a complaint, please email evtopa.com@gmail.com. You may also submit a complaint via the European Commission’s Online Dispute Resolution Platform: https://ec.europa.eu/consumers/odr/ (Regulation (EU) 524/2013).
- GOVERNING LAW AND JURISDICTION These Terms are governed by Spanish law. Disputes shall be submitted to the courts of your place of residence when you are a consumer.
- AMENDMENTS We may amend these Terms at any time. The new version will be published on the Site and will apply to orders placed after its effective date.
